Kişisel Verilerin Korunması ve İşlenmesi Aydınlatma Metni

İşbu Aydınlatma Metni, 6698 sayılı Kişisel Verilerin Korunması Kanunu'nun ("KVKK") 10. maddesi ile Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ kapsamında, Tixenta ürünü ve tixenta.com web sitesi üzerinden sunulan demo talep formu aracılığıyla işlenen kişisel verilerinize ilişkin olarak siz ilgili kişileri bilgilendirmek amacıyla hazırlanmıştır.
1. Veri Sorumlusu
Kişisel verileriniz, veri sorumlusu sıfatıyla Teknotel Telekomünikasyon Sanayi ve Ticaret A.Ş. ("Teknotel" veya "Şirket") tarafından aşağıda açıklanan kapsamda işlenmektedir.

Demo talep formunu doldurmanız hâlinde aşağıdaki kişisel verileriniz işlenmektedir:

3. Kişisel Verilerin İşlenme Amaçları
- Demo/ürün tanıtım talebinizin alınması, değerlendirilmesi ve size geri dönüş sağlanması,
- Talebinize ilişkin iletişimin yürütülmesi ve satış/teklif süreçlerinin planlanması,
- Hizmetlerimizin tanıtılması ve ürün kullanım senaryonuza uygun sunum hazırlanması,
- Form üzerinden gelen taleplerin kayıt altına alınması ve talep geçmişinin yönetilmesi,
- Bilgi güvenliğinin sağlanması, kötüye kullanım/spam'in önlenmesi ve hukuki yükümlülüklerin yerine getirilmesi.
4. Kişisel Verilerin İşlenmesinin Hukuki Sebepleri
Kişisel verileriniz KVKK'nın 5. maddesinde yer alan aşağıdaki hukuki sebeplere dayanılarak işlenir:
- Md. 5/2-c: Bir sözleşmenin kurulması veya ifasıyla doğrudan ilgili olması (demo/teklif sürecinin yürütülmesi),
- Md. 5/2-ç: Veri sorumlusunun hukuki yükümlülüğünü yerine getirebilmesi,
- Md. 5/2-f: İlgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için zorunlu olması (taleplerin yönetimi, bilgi güvenliği),
- Md. 5/1 (Açık Rıza): Yurt dışına aktarım gerektiren analitik/çerez işlemleri ile ticari elektronik ileti gönderimi yönünden açık rızanız bulunması.
5. Kişisel Verilerin Toplanma Yöntemi
Kişisel verileriniz; tixenta.com web sitesindeki demo talep formunu doldurmanız suretiyle elektronik ortamda, otomatik ve kısmen otomatik yollarla toplanmaktadır.
6. Kişisel Verilerin Aktarılması
Kişisel verileriniz, yukarıdaki amaçlarla sınırlı olarak ve KVKK'nın 8. ve 9. maddelerine uygun şekilde aşağıdaki taraflarla paylaşılabilir:
- Hizmet sağlayıcılar: E-posta/SMTP altyapısı, sunucu ve barındırma (hosting) hizmeti aldığımız tedarikçiler,
- Analitik hizmet sağlayıcı: Site kullanım istatistikleri için Google Analytics (Google LLC). Bu kapsamda bazı verileriniz yurt dışında bulunan sunuculara açık rızanıza dayanarak aktarılabilir,
- Bot/spam koruması: Form güvenliği için Google reCAPTCHA (Google LLC) kullanılır; bu kapsamda IP adresi ve etkileşim verileriniz Google'ın yurt dışındaki sunucularına aktarılabilir,
- Yetkili kamu kurum ve kuruluşları: Yasal yükümlülüklerimiz gereği talep edilmesi hâlinde mevzuatın öngördüğü ölçüde.
7. Kişisel Verilerin Saklama Süresi
Kişisel verileriniz, işleme amacının gerektirdiği süre boyunca ve ilgili mevzuatta öngörülen zamanaşımı süreleri dikkate alınarak saklanır; amaç ortadan kalktığında veya talebiniz hâlinde KVKK'ya uygun olarak silinir, yok edilir veya anonim hâle getirilir.
8. İlgili Kişi Olarak Haklarınız
KVKK'nın 11. maddesi uyarınca veri sorumlusuna başvurarak;
- Kişisel verilerinizin işlenip işlenmediğini öğrenme,
- İşlenmişse buna ilişkin bilgi talep etme,
- İşlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme,
- Yurt içinde/yurt dışında aktarıldığı üçüncü kişileri bilme,
- Eksik veya yanlış işlenmişse düzeltilmesini isteme,
- KVKK md. 7'deki şartlar çerçevesinde silinmesini/yok edilmesini isteme,
- Düzeltme/silme işlemlerinin verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
- Münhasıran otomatik sistemlerle analiz sonucu aleyhinize bir sonuç çıkmasına itiraz etme,
- Kanuna aykırı işleme sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme
haklarına sahipsiniz.
9. Çerezler ve Analitik
Web sitemizde, kullanıcı deneyimini iyileştirmek ve site trafiğini ölçmek amacıyla çerezler kullanılır. Site kullanım istatistikleri Google Analytics (GA4) aracılığıyla toplanır ve bu analitik çerezler yalnızca sitedeki çerez bildiriminde "Kabul Et" seçeneğini işaretlemeniz hâlinde çalışır (Google Consent Mode). Onayınızı dilediğiniz zaman sayfanın alt kısmındaki Çerez Tercihleri bağlantısından değiştirebilir; ayrıca çerezleri tarayıcı ayarlarınızdan da yönetebilir veya silebilirsiniz.
10. Başvuru Yöntemi
Haklarınıza ilişkin taleplerinizi, "Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ"e uygun olarak contact@tixenta.com adresine e-posta ile, KEP üzerinden teknotel.telekom@hs01.kep.tr adresine veya Kozyatağı Mahallesi Saniye Ermutlu Sokak No:10 1/A, 34742 Kadıköy / İstanbul adresine yazılı olarak iletebilirsiniz. Başvurularınız, talebin niteliğine göre en geç 30 (otuz) gün içinde sonuçlandırılır.

This Privacy Notice has been prepared pursuant to Article 10 of the Turkish Law No. 6698 on the Protection of Personal Data ("KVKK") and the related Communiqué on the Procedures and Principles to be Followed in Fulfilling the Disclosure Obligation, in order to inform you, as the data subject, about the personal data processed through the demo request form provided on the Tixenta product and the tixenta.com website.
1. Data Controller
Your personal data is processed by Teknotel Telekomünikasyon Sanayi ve Ticaret A.Ş. ("Teknotel" or the "Company"), acting as the data controller, within the scope explained below.

2. Personal Data We Process
If you fill in the demo request form, the following personal data is processed:

3. Purposes of Processing
- Receiving and evaluating your demo/product request and getting back to you,
- Conducting communication regarding your request and planning sales/offer processes,
- Promoting our services and preparing a presentation suited to your use case,
- Recording requests submitted via the form and managing request history,
- Ensuring information security, preventing abuse/spam and fulfilling legal obligations.
4. Legal Grounds for Processing
Your personal data is processed based on the following legal grounds set out in Article 5 of the KVKK:
- Art. 5/2-c: Being directly related to the conclusion or performance of a contract (conducting the demo/offer process),
- Art. 5/2-ç: Being necessary for the data controller to fulfil its legal obligation,
- Art. 5/2-f: Being necessary for the legitimate interests of the data controller, provided that it does not harm your fundamental rights and freedoms (request management, information security),
- Art. 5/1 (Explicit Consent): Your explicit consent for analytics/cookie operations that require cross-border transfer and for sending commercial electronic messages.
5. Method of Collection
Your personal data is collected electronically, through automated and partially automated means, by your filling in the demo request form on the tixenta.com website.
6. Transfer of Personal Data
Limited to the purposes above and in accordance with Articles 8 and 9 of the KVKK, your personal data may be shared with:
- Service providers: Suppliers from whom we receive e-mail/SMTP infrastructure, server and hosting services,
- Analytics service provider: Google Analytics (Google LLC) for site usage statistics. In this context, some of your data may be transferred to servers located abroad based on your explicit consent,
- Bot/spam protection: Google reCAPTCHA (Google LLC) is used for form security; in this context your IP address and interaction data may be transferred to Google's servers located abroad,
- Authorised public institutions: To the extent required by legislation, where requested under our legal obligations.
7. Retention Period
Your personal data is retained for as long as required by the processing purpose, taking into account the statute of limitations set out in the relevant legislation; once the purpose ceases or upon your request, it is deleted, destroyed or anonymised in accordance with the KVKK.
8. Your Rights as a Data Subject
Pursuant to Article 11 of the KVKK, by applying to the data controller, you have the right to:
- Learn whether your personal data is processed,
- Request information if it has been processed,
- Learn the purpose of processing and whether it is used in accordance with its purpose,
- Know the third parties to whom it is transferred domestically or abroad,
- Request rectification if it is incomplete or processed incorrectly,
- Request deletion/destruction within the conditions of Article 7 of the KVKK,
- Request that rectification/deletion operations be notified to third parties to whom the data was transferred,
- Object to a result against you arising solely from analysis by automated systems,
- Claim compensation if you suffer damage due to unlawful processing.
9. Cookies and Analytics
Our website uses cookies to improve user experience and measure site traffic. Site usage statistics are collected via Google Analytics (GA4), and these analytics cookies run only if you select "Accept" in the cookie notice on the site (Google Consent Mode). You can change your consent at any time via the Cookie Preferences link at the bottom of the page; you can also manage or delete cookies from your browser settings.
10. How to Apply
You may submit your requests regarding your rights, in accordance with the "Communiqué on the Procedures and Principles of Application to the Data Controller", by e-mail to contact@tixenta.com, via registered e-mail (KEP) to teknotel.telekom@hs01.kep.tr, or in writing to Kozyatağı Mahallesi Saniye Ermutlu Sokak No:10 1/A, 34742 Kadıköy / İstanbul. Your applications are concluded within thirty (30) days at the latest, depending on the nature of the request.
